Welcome to Isaga and the Terms and Conditions that define the rules and regulations for the use of our website: www.isaga.pt – property of the company Paulo da Cruz Lda.

The terms and conditions of sale are agreed between PAULO DA CRUZ Lda., headquartered at Largo do Carmo, 26, 1200-092 Lisbon, NIPC 502520710 and hereinafter referred to as ISAGA and the people who wish to make purchases through the website: https:// www.isaga.pt hereinafter referred to as “User”:

The parties agree that purchases made through the aforementioned website will be regulated exclusively by this contract.

Article 1 – Purpose

The purpose of these general terms and conditions of sale is to provide and define all the information necessary for the User regarding: orders, payments and deliveries made on the website: www.isaga.pt

These conditions regulate all the steps necessary to place an order and guarantee its tracking between the two Contracting Parties.

Article 2 – Products

Although the products are characterized with the utmost care and are photographed and/or captured on video using professional means, the aim is to convey an image that is as close to reality as possible. In specific cases, there may be differences in tone. It should be noted that computer monitors vary, however, we can guarantee that the item you receive will be very close to the one photographed.

The articles/products are handcrafted and not mass produced, and may present variations in texture, color and finish. This is not a defect, but rather a feature of the uniqueness of the product presented.

Article 3 – Order

The user completes their order by adding the product(s) they purchase to the shopping cart.

To submit your order, the User must:

• Register on the website www.isaga.pt by filling in the requested fields;
• Log in (providing an email and password combination chosen by the User when registering).
• After registering as a customer, the User can start accessing their personal account online by logging in.

On the Isaga.pt website you can also make purchases without logging in, completing the information and choosing the options available to you throughout the order process (delivery address and billing address, shipping method, payment method, as well as name and tax number, if you wish them to appear on the invoice).

The final confirmation of the order by the User is equivalent to full and complete acceptance of the articles described and their respective prices, as well as the General Terms and Conditions of Sale – the only ones applicable to the contract thus concluded.

The data contained in the invoice are the sole responsibility of the User. Once the invoice has been issued, it cannot be reissued with changes.

The order is considered completed upon payment.

When accessing your personal online account, the User is subject to these general conditions, as well as the legal and regulatory standards that govern the respective operation and use of the website.

Article 4 – Stock Availability

Isaga undertakes to send orders received online according to available stock.

The availability of our products is subject to change.

If the selected item is not available in stock, we will contact the User to inform them of the manufacturing time required. The manufacturing time is usually around 2-3 weeks.

@isaga takes the liberty of updating and/or modifying, at any time, the information, articles, prices, promotions and commercial conditions.

Article 5 – Prices

All prices for @isaga products listed on the website https://www.isaga.pt/ include Value Added Tax (VAT) at the current rate of 23%.

If there is an error in the price of the products ordered, either @isaga or the User may, at any time, up until the products are shipped, cancel the order.

Prices are always subject to final validation and in accordance with the invoice issued for the purchase.

Article 6 – Promotions and Sales

You can find different promotions at @isaga in the form of percentage discounts on the retail price and/or in the form of discount codes that can be percentage or value-based. Discount codes can also be related to the shipping cost, whether national or international.

All promotions have a specific period of validity and comply with commercial practices with price reduction, regulated by Decree-Law no. 70/2007, of March 26 – “Law on Sales, Promotions and Liquidations” – with the most recent amendments introduced by Decree-Law no. 109/2019, of August 14, rectified by Rectification Declaration no. 38/2019, of August 21.

To benefit from the reduced price of the items presented on the website https://www.isaga.pt/ the order must be completed and paid by the User by:

• end of promotional period (or campaign) announced
• limit of available stock depending on which occurs first.

Saving a product in the “shopping cart” or “favorites” does not guarantee its availability, price or applicable discount.

Article 7 – Payment

On the website: http://www.isaga.pt payment for the respective orders can be made through the payment management entity, RedUnicre — via SIBS - or Paypal.

The privacy and security of documents and information transmitted via the Internet is guaranteed by the above-mentioned and identified contractual partners.

The payment methods available on the @Isaga website are:

• Credit card – (Visa; Maestro; Mastercard)
• Multibanco Reference
• MB Way
• PayPal
• Bank Transfer – by email request: geral@isaga.pt

In the case of payments by credit card, the User will be charged after confirmation of dispatch of the items. If the product(s) ordered are out of stock, the amount will be released to the User's card.

Article 8 – Delivery

The order will be sent within 24 – 48 hours after payment confirmation. Cancellation of the respective order or any modification thereof must be made, preferably, before shipping.

@isaga takes the liberty of having a national and international shipping cost policy that varies throughout the year.

@isaga undertakes that the shipping price policy applied in a given period of time will be presented on the website www.isaga.pt in an explicit and visible manner.

For example, Isaga may organize advertising campaigns with Free Shipping for an unlimited or limited period; free shipping campaigns from a certain amount; with an unlimited or limited period. It may also offer discount codes.

8.1 – National Shipments:

Isaga currently uses the services of the company MRW Entregas www.mrw.pt with delivery until 7:00 pm on the next business day in mainland Portugal and Spain.

For the Autonomous Region of the Azores and the Autonomous Region of Madeira*, deliveries will be made via the national CTT service – registered mail or CTT Expresso, with a delivery time of 1 – 4 working days in most cases.

* For these destinations, in certain cases, the delivery deadline may not be respected by our contractual partner for reasons beyond Isaga's control.

8.2 – International Shipping:

At the moment, @isaga uses the services of FedEX Express companies internationally, except Spain (as per article 9.1).

In Europe, deliveries are made within 1–2 working days.

For the USA and Canada our deliveries are made within 2-3 business days.

For the Rest of the World our deliveries are made in 5-6 working days.

FedEx Express partner companies reserve the right not to deliver to PO Boxes. There are situations such as “remote areas” and “customs clearance process” that may delay the above-mentioned intervals and result in some price changes to be confirmed.

Article 9 – Pricing policy, international level

For NON-EU countries (excluding the USA*) the 23% VAT rate is automatically deducted in the shopping cart when adding the shipping address.

Attention: upon receiving the order, the customer will pay taxes corresponding to the destination country!
